1. Definitions

“Service” means the EducateAI platform and all associated features at https://www.educate-ai.com/.

“User” means any natural or legal person who accesses or uses the Service.

2. Scope and Acceptance

By accessing or using the Service, you agree to these Terms & Conditions. If you do not agree, do not use the Service.

3. Provision of the Service

EducateAI grants you a limited, non-exclusive, non-transferable license to use the Service per these Terms.

4. User Accounts

To access certain features, you must register and keep your account information accurate. You are responsible for safeguarding your credentials and all activities under your account.

5. User-Generated Content and Moderation

You retain ownership of content you submit, but grant EducateAI a license to use it to provide the Service.

We may remove content that violates these Terms or applicable law. You will be informed of the reasons for removal and can appeal by contacting contact@educate-ai.com. Appeals will be reviewed within 14 days.

6. Intellectual Property

All software, text, graphics, logos, and other materials provided through the Service are proprietary to EducateAI or its licensors and protected by copyright and other IP laws.

7. Fees and Payment

Use of the Service may be free or subject to subscription fees managed via Polar Payments. For details, see our Pricing page.

8. Conformity and Remedies

If digital content or services lack conformity, you may request repair or replacement. Failing that, you may obtain a price reduction or terminate the contract. All remedies will be provided without undue delay, and refunds processed within 14 days of your request.

9. Right of Withdrawal (Consumers)

Consumers have a 14-day right to withdraw from distance contracts without reason, starting from contract conclusion. To exercise this right, use the model withdrawal form (Annex I(B)) or any clear statement. If we begin digital performance with your prior express consent and acknowledgement of loss of withdrawal right, it is excluded.

10. Severability

If any provision of these Terms is deemed unfair or invalid, that provision shall be severed, and the remaining Terms shall continue in full force.

11. Disclaimer of Warranties

The Service is provided “as is,” without warranties of any kind, to the fullest extent permitted by law.

12. Limitation of Liability

To the maximum extent permitted by law, EducateAI shall not be liable for indirect, incidental, or consequential damages arising from the Service.

13. Indemnification

You agree to indemnify and hold harmless EducateAI from any claim, loss, or expense arising from your breach of these Terms or misuse of the Service.

14. Alternative Dispute Resolution

Since the EU ODR platform is discontinued, for out-of-court dispute resolution you may contact a national ADR body such as the General Consumer Conciliation Body in Germany (EVZ).

15. Governing Law and Jurisdiction

These Terms are governed by German law, but you may also bring proceedings in your Member State of residence under EU consumer protection rules.

16. Changes to Terms

We may modify these Terms at any time. Changes are effective upon posting. Continued use indicates acceptance.
